Terms of User

Introduction

We are Mango Auctions Ltd using the trading name of Mango Estates.  We are a company incorporated by ordinary shares in England and Wales under company number 15381315.  Our registered office is Unit 1, Robin Mills, Leeds Road, Idle, Bradford, England, BD10 9TE

This Terms of User Agreement sets out the rules, specifications and requirements for the use of our website and digital platform.  When we refer to ‘Mango Estates’, ‘Mango’, ‘we’, ‘us’, and ‘our’ we are referring to Mango Auctions Ltd trading as Mango Estates.  When we refer to ‘website’ we are currently referring to www.mangoestates.com and/or any App and related functionality service and content offered by Mango Auctions Ltd trading as Mango Estates unless specified otherwise.  For the avoidance of doubt this Terms of User Agreement covers all our digital services and content.

By using Mango Estates’ website, you agree to be legally bound by these terms, which take immediate effect on first use of the Mango Estates website.  If you use our services on behalf of a business, that business agrees to these terms.  This Agreement is between you and us and no one else has any right to enforce its terms.

You must be 18 years of age or over and legally capable of entering into binding contracts to use our website.

We encourage you to read these terms in this Agreement before using our services. However, whenever you use our services, you agree to these terms.  Mango Estates reserve the right at its discretion to suspend or terminate your use of our website and content and suspend or terminate your use of all of our services if in contravention of this Agreement.

If you do not accept the terms of this Agreement, you must immediately exit our website otherwise you will be deemed to accept the terms by continuing.

Mango Estates may change the terms of this Agreement and post the changed Agreement on their website.  At that point the changes are effective and binding.  We encourage you to review the terms from time to time to ensure you are aware of any changes made.

Prohibited Use and Activities

You agree to use Mango Estates website solely for lawful purposes.  You further agree not to infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of our website.

Below is a list of behaviours, which are not acceptable, taking into consideration the above paragraph.  This is not an exhaustive list:

  • Providing false information. Be honest with us;
  • Hacking activities;
  • Tampering with the website;
  • Introducing any material which is malicious or harmful;
  • Allowing third parties to pretend to be you or giving them access to any password or code we may provide you to use;
  • Trying to get around our content security technology being the software that stops people copying our content;
  • Using data gathering or data extraction tools, such as robots on our website;
  • Copying in part or whole the website for personal or business use;
  • Recreating a service or copying the look of our service;
  • Using our brands and logos or any registered trademarks without our permission;
  • Violating copyright laws at all;
  • Using or mentioning our content in marketing, advertising or press releases;
  • Making money from our content or services;
  • Pretending to be us or affiliated or associated with us;
  • Exaggerating your relationship with us;
  • Inappropriate, false or misleading content when posting about us or other users;
  • Attempting to damage our reputation or those of others who use our services; and
  • Engaging in activities to try to obtain a property for less or sell a property for more;

Hacking activities, introduction of malicious or harmful material, attempting to gain access to our website, server or wherever our data is stored or using any form of attack to disrupt services of Mango Estates may be a breach of relevant statute and constitute a criminal offence.  We will always contact relevant law enforcement authorities and reserve the right to disclose your identity to them in keeping with legal provisions. We will always press for the law authorities to pursue criminal charges and fully cooperate with them. If we identify a breach, we will withdraw the right to use our site immediately.

Mango Estates will not be liable for any loss or damage arising from any malicious or harmful material that may infect your computer equipment, computer programs, or data or any other proprietary material whilst using our website or downloading from our website or any website connected to it.

Third Party Use by Consent or Otherwise

It is your responsibility to ensure that no one gains access to your Mango Estates account and/or pretends to be you and provide information to us pretending to be you.  You must refrain from sharing your personal information with others or allowing them to complete information posing as you even if you consent for them to do so.  You are to be careful who you share information with and where you choose to leave your digital equipment.  Mango Estates bares no responsibility if any of the above comes into existence. 

Mango Estates prohibits any user sharing their details with third parties and those third parties pretending to be you or using your details to gain an advantage in any way shape or form.

Mango Estates will accept no liability for the above in any way shape or form.   You maintain full responsibility. If you believe someone has used your account details or any password or code to enter parts of our website you must tell us immediately.  Mango Estates reserves the right to block your account and restrict your access at any time.  If you find yourself blocked, please contact us.  Mango Estates is under no obligation to reactivate your account.

Disclaimers and Limitation of Liability

Mango Estates takes great care to make the contents of our website the best they can be. However, we do not accept any responsibility for any loss or damage arising out of or in any way connected with the use of Mango Estate’s website or reliance on the information on our website including, but not limited to, indirect or consequential loss or damage, loss of revenue or loss of anticipated revenues, loss of business opportunities, loss of goodwill, loss of data or damage to reputation, loss of profit and contracts, loss of any anticipated saving, wasted time whether office or management or any other type or any other losses flowing from the same. 

The information provided on Mango Estates’ website is intended to be used for illustrative purposes alone.  It does not constitute investment or other professional advice. You must not rely on this information on our website as a substitute for such professional advice or for any other purpose.

With regard to the properties offered through Mango Estates, which are for sale via the website and/or to let, Mango Estates both on its own behalf and as agent gives the following notice to all users:

  • All particulars appearing on our website do not in whole or in part constitute an offer or contract for the purchase of a property advertised;
  • None of the statements appearing in the particulars to a property on our website are to be relied on as statements or representations of fact; and
  • Neither the owner of the property being sold or let make or give, Mango Estates or any of its members or any person in its employment or anyone holding themselves out as a consultant or affiliate or agent has any authority to make or give, any representation or warranty whatsoever in relation to the property.

For the avoidance of doubt the only representations, warranties, undertakings and contractual obligations to be given or undertaken by the selling party (vendor/lessor) or owner letting a property are those contained and expressly referred to in the written contract for sale or agreement for lease between the seller (vendor/lessor) and a purchaser or letting agreement.

Prospective purchasers or tenants should:

  • Satisfy themselves as to the correctness of each statement contained in the particulars for the property;
  • Inspect the property and the neighbouring area;
  • Ensure that any items expressed to be included are available and in working order;
  • Arrange a full structural (and where appropriate environmental) survey of the property; and carry out all necessary searches and enquiries if purchasing.

Nothing in these terms shall operate to limit or exclude Mango Estate’s liability for:

  • Death or personal injury caused by the negligence of Mango Estates;
  • Damage suffered by you as a result of any breach of the condition as to title under Part 1 of the Consumer Protection Act 1987 by Mango Estates;
  • Breach of the warranty as to quiet possession implied by Section 12 of the Sale of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982; and
  • Fraud including, but not limited to, fraudulent misrepresentation.

Further Mango Estates does not guarantee that access to and use of the website will be uninterrupted or error-free.  Mango Estates will from time to time need to carry out maintenance, repairs or introduce new facilities and may suspend or restrict access to the website. 

Mango Estates does not warrant that the information on our website is accurate or complete and is not responsible for checking that information is accurate or complete.

Mango Estates is not liable for things that happen that could not be reasonably foreseen or the event that happens would not usually result or did not result from any alleged mishap of Mango Estates.

If our website mentions products, services of third parties, their companies and websites it is for information purposes alone and does not constitute a recommendation or endorsement.  Any user must order directly from third parties their products or services.

If Mango Estates website contains links to websites run by other organisations or businesses, be aware every effort is made to check the content and accuracy of the websites linked with Mango Estates.  However, Mango Estates takes no responsibility for information contained on websites maintained by other organisations or businesses or for action taken as a result of information contained on websites maintained by other organisations and businesses.

Intellectual Property

Mango Estates does not give you permission to copy, republish, reproduce, post, broadcast, download, transmit or otherwise use the Mango Estates website in anyway except for your own personal use in using our services only.  Please apply for written permission to undertake any of the above.  Any use of the Mango Estates website content requires prior written permission from us.

Be aware that the names, logos and images, designs, videos and animation identifying us or any third parties and their products or services and the other content of our website, including the software incorporated into it, are subject to copyright, trademarks, design rights and other intellectual property rights and remain the property of Mango Estates and/or third parties.

Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right, copyright or other intellectual property rights of Mango Estates or any other third party.

Access to our Website

Access to our website is permitted on a temporary basis only.  We reserve the right to amend or withdraw the service we provide on our website without notice, subject to the terms of this Agreement.  We will not be liable if our website is unavailable any time and for any period.

We reserve the right to suspend and permanently block you from our website at any time if in our opinion you have failed to comply with any provisions in our Terms of Use.

Restricted Access

Access to certain areas of our website is restricted. You may be permitted to access those restricted areas if you comply with the terms of access thereto and at our sole discretion.

Force Majeure Events

We shall not be liable for any failure to perform any obligation under this agreement if such failure is caused by events beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, riots, civil unrest, government actions and restrictions, pandemics, industrial actions, lock-outs, strikes, fire, floods, earthquakes, explosions and natural disasters, disruption to telecommunication services whether private or public networks, disruption to transport systems whether public or private or any other event that makes it impossible or impracticable to access our website or complete a purchase.  This list is not exhaustive.   Such events include an act, event, non-happening, omission or accident, which is beyond our control.   In such cases, our obligations will be suspended for the duration of the event.

Variation of Terms and Conditions

We reserve the right to revise and amend these terms and conditions at any time, including to comply with changes in applicable law.  The revised and amended terms and conditions will be uploaded and come into effect on uploading.  Use of our website following uploading of the revised and amended terms and conditions constitutes acceptance of those changes.  If you do not accept the revised and amended terms and conditions you should exit the website immediately.  Users are advised to periodically review the terms and conditions to stay informed of any modifications.   Failure to do so does not negate acceptance of such terms and conditions by use of the website.

Jurisdiction and Governing Law

The terms of this agreement shall be governed and construed in accordance with the laws of England and Wales as such only the courts of England and Wales can make judgements about the terms of this agreement.

Severance and Waiver

If any provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction or otherwise rendered so by any applicable law, such provision shall be deemed amended to conform to applicable Laws so as to be valid and enforceable, or, if it cannot be so amended without materially altering the intention of the Parties, it shall be stricken from this Agreement, and the remainder of this Agreement shall remain in full force and effect.

No delay on the part of Mango Estates in enforcing any provision of this Agreement shall constitute a waiver or create a precedent or in any way prejudice Mango Estates’ right under the terms of this Agreement.

Entire Agreement

This Agreement contains the entire agreement and replaces all previous agreements between you and us about using our services or content.
